Let's destroy countless hard drives that may or may not belong to the guilty parties without due process of law. It always works well, having a cure that's worse than the disease.
It's irrelevant: music files aren't code, so such a virus would have to take advantage of an overflow bug in a particular MP3 decoder, and would be quickly patched.

I think Misfit really wants the gub'mint to mandate that hard drive makers have an off-only switch in their hard drives that can be triggered on-demand by goons from the recording industry because the recording industry is full of angels that would never abuse their government-granted power and, as we all know, you have nothing to fear if you're not breaking the law, right? ;-)
